| 中国城市林业建设引入市场化运作的法律探索 |

摘要:本文是初步探索城市林业建设走市场化模式所必须克服的法律问题，进行市场化运作必须解决产权归属问题，但城市的林业是归国家所有，土地也是国家的，产权是明确的；这就给城市林业建设市场化运作带来了最大的障碍，笔者提出了绿色产权交易制度的概念，其定义为是一种特殊的相对所有权和非公有林权的延伸，是国家把城市林业的建设引入市场化运作，以求达到最大的经济效益和生态效益和社会效益的统一的行为方式，这样私人投资城市林业建设就能够解决法律问题，本文通过了大量的理论来论证这个行为模式的合法性和可行性，并阐述了绿色产权交易的基本特征和法律关系。
